How to Obtain a Marriage License in Montgomery County, MD

Getting married is one of the most amazing times in a couple’s life. There are parties such as engagement parties, showers, rehearsal dinners and then the wedding day. Amidst all of the wedding festivities are the MUST DO things - one of which is obtaining your marriage license. Here are some helpful tips and information so that you know what to do and expect.


1)      You MUST obtain the marriage license from the county in which you plan to be married. Knowing that, first and foremost you need to find your wedding venue so that you apply in the correct county. So, you may reside in Montgomery County but decide to get married in Frederick County. Then your license needs to come from Frederick, MD. However, if you reside in Montgomery County and you are getting married in Montgomery County, you get the license from the Montgomery County Courthouse. NOTE- If you reside out of state, you may go to your local courthouse and get an affidavit. You may then fill out the application for Montgomery County (NON-RESIDENT MARRIAGE LICENSE APPLICATION), attach that with the affidavit, fee, then mail it in. I would do that certified mail so that someone needs to sign for it to ensure that it got there. Likewise, they will then mail the marriage license back to you through regular mail. I would do it this way before you need it in case something gets lost, and you need to resubmit everything. Personally, unless I lived really far away, I would just go there and get it done.

2)       Both parties in the couple no longer need to be present. At one time you both needed to be present to apply, but happily that has changed. However, you must make sure that you have proper ID for both of you such as a driver’s license, MVA identification card, birth certificate or passport. A photocopy of the absent persons identification is acceptable identification.

3)      Go to the License Department at the Circuit Court, located at 50 Maryland Avenue, North Tower, First Floor, Room 1300, Rockville, MD 20850.

4)      You must fill out the application in person.

5)      If you reside in Montgomery County, you must apply in person. If you reside outside of Montgomery County, you may download the form - NON-RESIDENT MARRIAGE LICENSE APPLICATION - to fill out in advance and online - don’t forget to print the application to take with you.

6)      The information is pretty basic. However, if either party has been married before they must provide the date and place of each death or judicial determination that ended any former marriage.

7)      Cost- make sure that you have cash, a credit card, or money order to pay the $55.00 fee.

8)      You will be able to take the marriage license with you that same day.

9)      There is a 48-hour waiting period before the license is valid.

10)  The license is good for six months.

1)     Ceremonies are held by appointment only. Appointments can made in person or by calling (240) 777-9460.

2)      You must pay the $25.00 fee on the day of your wedding via cash or money order.

3)      Remember that you must wait at least 48-hours after you get your license to get married.

4)      Return to the 50 Maryland location location and proceed back to License Department where you received your marriage license. Please arrive 10 minutes before your appointment.

5) Both parties must present a valid, government-issued ID at the time of check-in.

6)      The ceremony will take place in The Ceremony Room.

7)      A couple is given 10 minutes for their ceremony.

8)      You are allowed a maximum of 10 guests.
